These terms govern your use of GreetingHQ, a service operated by Dowsett Rogers Pty Ltd. In these terms, “GreetingHQ”, “we”, “us” and “our” refer to the service and its operator.
1. Agreement to these terms
By accessing GreetingHQ, creating an account, purchasing card credits, creating a card or contributing to a card, you agree to these terms and our Privacy policy. If you do not agree, do not use the service.
If you use GreetingHQ for an organisation, you confirm that you have authority to accept these terms for that organisation. The organisation is responsible for activity carried out through its account.
2. Accounts and eligibility
You must provide accurate information, keep it current and protect your sign-in details. You are responsible for activity under your account and should tell us promptly through our contact page if you believe it has been compromised.
You must be able to enter into a binding agreement. If you are under 18, you may use GreetingHQ only with the permission and supervision of a parent or guardian.
An account belongs to the person or organisation that created it. Invitations to join an organisation must use an address that is not already attached to another GreetingHQ account. Accounts are not merged automatically.
3. Using GreetingHQ
GreetingHQ lets people create group cards, choose or submit designs, invite contributors, add messages and media, and deliver cards immediately or at a scheduled time. Features may differ between free and paid cards.
A card’s signing link is intended to be shared with its contributors. Anyone who receives a valid link may be able to view and contribute to the card without an account, so the card organiser is responsible for sharing it only with intended people. We may invalidate a link where we reasonably believe it has been misused.
The organiser is responsible for recipient details, contributor invitations, content, permissions and delivery settings. Delivery depends on third-party networks and services, so we cannot guarantee that every notification will arrive at a particular time. Once a card is delivered, its cover, content and signatures are locked against further editing.
4. Payments, card credits and promotions
Current prices, currencies and inclusions are shown on our pricing page and at checkout. GreetingHQ does not charge a subscription. Purchased card credits do not expire and are applied to the account shown at checkout. A credit may be consumed when a paid card is created or upgraded, as described during that flow.
Payments are processed by a third-party payment provider. You authorise that provider to charge the amount shown at checkout and agree to its applicable terms. We do not store complete payment-card details.
Promotion codes may have separate eligibility, expiry and usage limits. They cannot be exchanged for cash or combined unless expressly stated. We may reject or reverse a promotion that was obtained or used through error, fraud or abuse.
Refunds and other remedies are available where required by the Australian Consumer Law. For other purchase issues, use our contact page; requests are assessed on their circumstances. If a payment is refunded or reversed, we may remove the related unused credits.
5. Your content and permissions
“Your content” includes card messages, names, photos, videos, GIFs, signatures, uploaded designs, prompts, reference images and other material you or your contributors submit. You retain any rights you hold in your content.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt, transmit and display your content only as reasonably needed to operate, secure, support and improve GreetingHQ, deliver the card, and comply with law. This licence ends when the content is deleted from our systems, subject to reasonable backup, fraud-prevention and legal-retention periods.
You confirm that you have the rights and permissions needed to submit the content and allow us to use it in this way. You are responsible for obtaining consent from people shown or identified in your content. Do not submit confidential information unless you understand who can access the card.
We may remove, restrict or preserve content where reasonably necessary to enforce these terms, protect people or the service, investigate abuse, or comply with a lawful request.
6. Submitted designs and AI tools
When you upload a private or organisation-only design, we use it to provide the service to the relevant account. If you submit a design for public use, you also give us a non-exclusive, worldwide, royalty-free licence to review, crop, resize, display and make that design available in the GreetingHQ catalogue. Where you separately select social promotion, that licence also allows us to promote the approved design through GreetingHQ’s social channels. You may ask us to stop future public use through our contact page, but this will not undo lawful uses already made.
AI design tools are subject to concept, revision, rate and account limits. Prompts and any reference images you intentionally submit to an AI tool may be processed by an AI service provider to produce the requested result. AI output may be inaccurate, similar to output created for others, or unsuitable for your purpose. You are responsible for reviewing the output and ensuring that your use does not infringe another person’s rights.
You must not use the AI tools to generate unrelated material at scale, evade usage limits, automate requests, or create unlawful, deceptive, abusive or infringing content.
7. Acceptable use
You must not use GreetingHQ to:
- break the law, infringe intellectual property, privacy or publicity rights, or encourage harm;
- upload, generate or share obscene, pornographic, sexually explicit or otherwise indecent content, including any material that exploits, endangers or sexualises a child;
- harass, threaten, defame, discriminate against or impersonate another person;
- send spam, unsolicited bulk invitations, malware or fraudulent content;
- probe, bypass or interfere with security, rate limits, access controls or service availability;
- scrape, copy, reverse engineer or commercially exploit the service except where the law expressly permits it; or
- resell accounts or credits, or use another person’s account without permission.
We may investigate suspected misuse and cooperate with authorities where required by law.
8. GreetingHQ intellectual property
GreetingHQ, its software, branding, interface and catalogue content are owned by us or our licensors and protected by intellectual-property laws. These terms give you a limited, revocable, non-transferable right to use the service for its intended purpose. They do not transfer ownership of GreetingHQ or third-party content to you.
Third-party integrations, GIFs, fonts, payment services, sign-in providers and linked websites may be governed by their own terms. We are not responsible for third-party services outside our control.
9. Availability, consumer rights and liability
We work to keep GreetingHQ secure and available, but the service may occasionally be interrupted, changed or unavailable for maintenance, security, technical failures or events beyond our reasonable control.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where a guarantee cannot be excluded but our liability can lawfully be limited, our liability is limited, at our option, to supplying the relevant service again or paying the cost of having it supplied again.
To the maximum extent permitted by law, GreetingHQ is provided on an “as available” basis. We are not liable for indirect or consequential loss, lost profits, lost opportunity, or loss caused by content, instructions or recipient details supplied by users. Any other aggregate liability relating to the service is limited to the amount you paid GreetingHQ for the affected service in the 12 months before the event giving rise to the claim.
10. Suspension, termination and deletion
You may stop using GreetingHQ at any time and may request account deletion through the available account controls or our contact page. Deletion may be delayed where information must be retained for billing, security, dispute resolution or legal reasons.
We may suspend or end access, remove content or restrict features where we reasonably believe these terms have been breached, payment is disputed or fraudulent, continued use creates risk, or we must do so by law. Where practical, we will give notice and an opportunity to address the issue.
11. General terms
We may update these terms to reflect service, legal or operational changes. We will publish the revised version here and update the date above. If a material change affects existing users, we will take reasonable steps to give notice.
If any part of these terms is unenforceable, the remaining parts continue. A delay in enforcing a right is not a waiver. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a business restructure or sale, subject to applicable law.
These terms are governed by the laws of Victoria, Australia. Courts located in Victoria have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
